A RESOLUTION

AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE URBAN DRAINAGE AND FLOOD CONTROL DISTRICT (UFDCD) TO SHARE THE COST OF EASEMENT ACQUISITION FOR CERTAIN PARCELS REQUIRED FOR DRAINAGE IMPROVEMENTS ON LAKEWOOD GULCH UPSTREAM OF KIPLING STREET.

WHEREAS, Lakewood City Council approved Ordinances O-2004-45 and O-2005-1 authorizing rights-of-way acquisition for the 8th Place/Kipling Street drainage improvement project; and,

WHEREAS, certain parcels required for the project are eligible for acquisition cost sharing from UDFCD; and,

WHEREAS, the acquisition costs for the eligible parcels has been reasonably estimated.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, an Intergovernmental Agreement with the Urban Drainage and Flood Control District to share easement acquisition costs for certain parcels required for drainage improvements on Lakewood Gulch upstream of Kipling Street, in form approved by the City Attorney, in an amount not to exceed Thirty-five Thousand and No/100 Dollars ($35,000) and the City share shall not exceed Seventeen Thousand Five Hundred and No/100 Dollars ($17,500).

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on May 2, 2005, at 7 o'clock p.m. at Lakewood City Hall, 480 South Allison Parkway, Lakewood, Colorado.
