RESOLUTION: 2005-29

SUBJECT: A resolution approving an agreement between the City of Lakewood and the Agricultural Ditch and Reservoir Company.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Agricultural Ditch and Reservoir Company, a mutual ditch and irrigation company organized to provide water for the use of its shareholders, owns and operates three water storage reservoirs located in Jefferson County, Colorado, known as Smith, Main and East Reservoirs. The City of Lakewood has previously entered into an agreement with the ditch company to allow the City to utilize the reservoir properties for such recreational purposes as fishing, picnicking, jogging, bicycling and similar activities.

The City of Lakewood has applied for and been awarded a grant from the Colorado Division of Wildlife to construct a handicapped accessible fishing dock, shade shelter and informational signage at Main Reservoir. The City and the ditch company desire to enter into an agreement by which the ditch company grants to the City the right to construct and use the fishing dock, shade shelter and informational signage at Main Reservoir. Additionally, the agreement updates certain insurance, use and indemnification provisions from the earlier agreement entered into between the City and the ditch company.
