A RESOLUTION

AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND THE AGRICULTURAL DITCH AND RESERVOIR COMPANY FOR THE USE OF A HANDICAPPED ACCESSIBLE FISHING DOCK AT MAIN RESERVOIR

WHEREAS, the Agricultural Ditch and Reservoir Company, a mutual ditch and irrigation company organized to provide water for the use of its shareholders, owns and operates the Main Reservoir; and

WHEREAS, the City of Lakewood has previously entered into an agreement with the Agricultural Ditch and Reservoir Company to allow the City to utilize the reservoir properties for such recreational purposes as fishing, picnicking, jogging, bicycling and similar activities; and

WHEREAS, the City of Lakewood has applied for and been awarded a grant from the Colorado Division of Wildlife to construct a handicapped accessible fishing dock, shade shelter and informational signage at Main Reservoir; and

WHEREAS, the City of Lakewood and the Agricultural Ditch and Reservoir Company desire to enter into an agreement by which the ditch company grants to the City the right to construct and use the fishing dock, shade shelter and informational signage at Main Reservoir and to update the agreement regarding certain insurance, use and indemnification provisions.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, an Intergovernmental Agreement in a form approved by the City Attorney with the Agricultural Ditch and Reservoir Company relating to construction and use of a handicapped accessible fishing dock, shade shelter and informational signage at Main Reservoir.

INTRODUCED, READ AND ADOPTED by a vote of 9 for and 0 against at a regular meeting of the City Council on April 11, 2005, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
