RESOLUTION: 2005-22
SUBJECT: Authorizing a revocable license agreement to allow a canopy encroachment into a storm drainage easement.
ADDRESS: 9160 W. Colfax Avenue.
RECOMMENDATION: Approve the resolution.
FUNDING SOURCE: Application fee.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Safeway store located at the intersection of Colfax Avenue and Garrison Street proposes to construct a set of gasoline pumps with a canopy in the northwest corner of their property. The canopy will be located entirely within Safeway's property but a small portion would encroach upon a drainage easement that the City has along the north property line. The recorded easement prohibits building encroachments within the easement area. The intent of this was to assure that storm water could flow unimpeded along the easement. The encroachment will only extend a small portion the roof area into the easement with no structural members that would obstruct the flow of water.
The license agreement would allow the encroachment while protecting the City's property interests long term.
