RESOLUTION: 2005-14

SUBJECT: Resolution authorizing Revocable License Agreement for the construction of a fence, gate and knox box in City-owned right-of-way for West 8th Avenue, to Ronald A. Martinez and Sharla D. Martinez.

ADDRESS: 870 Kipling Street.

RECOMMENDATION: Authorization of the requested Revocable License Agreement.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Martinezes are in the process of developing their property at 870 Kipling Street. One of the requirements of the development was to provide a way for a fire truck to turn around at the end of the street because West 8th Avenue dead ends at Lakewood High School. There were two solutions to this problem which were construct a cul-de-sac bulb at the East end of West 8th Avenue or construct a fence with a gate and have a device know as a knox box connected to the gate that would allow the Fire Department to open the gate as they came down West 8th Avenue. Through a collaborative effort between the property owner, Jeffco Schools and West Metro Fire District it was felt the knox box solution would be the best solution because this would provide a better way for the Fire Department to reach the school as well as the back of the property at 870 Kipling Street. This would also provide a better way for the fire truck to get out of the area because the Fire Department could drive through the School parking lot to West 9th Place instead of having to turn their trucks around in a cul-de-sac bulb. The proposal has been reviewed by City staff, and is acceptable from the aspect of presenting no hazards or creating other problems.
