A RESOLUTION
AUTHORIZING A REVOCABLE LICENSE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND RONALD A. MARTINEZ AND SHARLA D. MARTINEZ, ACROSS WEST 8TH AVENUE ADJACENT TO THE PROPERTY AT 870 KIPLING STREET
WHEREAS, Ronald A. Martinez and Sharla D. Martinez, have requested a Revocable
License Agreement from the City of Lakewood to allow placement of a fence,
gate and knox box on land owned by the City as a portion of West 8th Avenue;
and
WHEREAS, the City wishes to allow said use of the portion of said street right-of-way
as described in Exhibit "A" attached hereto and made a part hereof,
for installation, maintenance and replacement of a fence, gate and knox box
in accordance with the terms and conditions of a Revocable License Agreement
issued by the City.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Revocable License Agreement between the City of Lakewood and Ronald A. Martinez and Sharla D. Martinez, in form approved by the City Attorney, for the use described above of the City-owned street right-of-way described in Exhibit "A" hereto.
INTRODUCED, READ AND ADOPTED by vote of 11 for and 0 against at a regular meeting of the City Council on March 28, 2005, at 7:00 o'clock p.m., at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.

A parcel of land lying in the Southwest One-quarter (SW¼) of Section 3, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, Stat e of Colorado, more particularly described as follows:
Commencing at the Southwest corner of said SW¼; thence N 14º53'37"
E (assuming the West line of said SW¼ bears N 00º05'09" E
all other bearings hereafter related thereto), a distance of 1,398.30 feet,
more or less, to the Southeast corner of Lot 35, Block 1, EVERLY'S SUBDIVISION
LOT LINE ADJUSTMENT NO. 1 PLAT, the plat of which is recorded in Plat Book
128, at Page 13, of the records to the Jefferson County Clerk and Recorder,
said Southeast corner lying on the West line of Lot 33, said Block 1, and
being the True Point of Beginning; thence S 00º07'01" W along said
last West line and the West line extended southerly of said Lot 33, said West
line and southerly extended West line being in common with the West line of
vacated West 8th Avenue as described in that instrument recorded at Reception
Number F0187169 and rerecorded at Reception Number F0190235, of said records,
a distance of 50.01 feet, more or less, to the South right-of-way line of
West 8th Avenue; thence S 89º16'57" W along said last right-of-way
line, a distance of 25.00 feet; thence leaving said last right-of-way line
N 00º07'01" E, a distance of 50.01 feet, more or less, to a southwesterly
corner of said Lot 35; thence N 89º16'57" E along a southerly line
of said Lot 35, said southerly line being in common with the North right-of-way
line of West 8th Avenue, a distance of 25.00 feet, more or less, to the True
Point of Beginning, the above described parcel contains an area of 1,250 square
feet, more or less.
