A RESOLUTION

APPROVING AN AMENDMENT TO AN AGREEMENT WITH THE URBAN DRAINAGE AND FLOOD CONTROL DISTRICT FOR FINAL DESIGN, RIGHT-OF-WAY ACQUISITION AND CONSTRUCTION OF DRAINAGE IMPROVEMENTS FOR GREEN MOUNTAIN DRAINAGEWAY B.

WHEREAS, the City of Lakewood's Stormwater Management Utility and the Urban Drainage and Flood Control District fund capital improvement projects; and

WHEREAS, the City and the Urban Drainage and Flood Control District have entered into an Intergovernmental Agreement for the preliminary design of drainage improvements for Green Mountain Drainageway B; and

WHEREAS, preliminary design has been completed for Green Mountain Drainageway B; and

WHEREAS, the Urban Drainage and Flood Control District and the City of Lakewood would like to proceed with final design, right-of-way acquisition and construction of drainage improvements to Green Mountain Drainageway B.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest to a contract amendment for final design, right-of-way acquisition and construction of drainage improvements including contingencies for Green Mountain Drainageway B, in form approved by the City Attorney. The total contract amount, including the amendment, shall not exceed One Million Eight Hundred Thousand and No/100 Dollars ($1,800,000) and the City's share shall not exceed One Million Three Hundred Ninety Thousand and No/100 Dollars ($1,390,000).

SECTION 2. The City Treasurer is hereby authorized to make payment to the Urban Drainage and Flood Control District in accordance with the terms of said amendment.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council on February 14, 2005, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
