A RESOLUTION

APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE URBAN DRAINAGE AND FLOOD CONTROL DISTRICT FOR EASEMENT ACQUISITION AND CONSTRUCTION OF DRAINAGE IMPROVEMENTS FOR SOUTH LAKEWOOD GULCH AT COLORADO CHRISTIAN UNIVERSITY.

WHEREAS, the City of Lakewood's Stormwater Management Utility and the Urban Drainage and Flood Control District fund capital improvement projects; and

WHEREAS, the City and the Urban Drainage and Flood Control District have entered into an Intergovernmental Agreement for the design of drainage improvements for South Lakewood Gulch at Colorado Christian University; and

WHEREAS, design is nearing completion for improvements to South Lakewood Gulch at Colorado Christian University; and

WHEREAS, the Urban Drainage and Flood Control District and the City of Lakewood would like enter to into an Intergovernmental Agreement to fund easement acquisition and construction of drainage improvements for South Lakewood Gulch at Colorado Christian University.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest to an Intergovernmental Agreement for easement acquisition and construction of drainage improvements for South Lakewood Gulch at Colorado Christian University, in form approved by the City Attorney, in an amount not to exceed One Million Eight Hundred Thousand and No/100 Dollars ($1,800,000) and the City share shall not exceed One Million Three Hundred Thousand and No/100 Dollars ($1,300,000).

SECTION 2. The City Treasurer is hereby authorized to make payment to the Urban Drainage and Flood Control District in accordance with the terms of said amendment.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council on February 14, 2005, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
