A RESOLUTION

A RESOLUTION FOR ENTERING AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF COLORADO DEPARTMENT OF PERSONNEL AND ADMINISTRATION.

WHEREAS, The City of Lakewood is developing the Aviation Park located at 1900 Teller Street; and

WHEREAS, the storm water drainage flows from the park and other upstream areas across the adjacent State of Colorado land to the East; and

WHEREAS, the City of Lakewood desires to meet its own storm water management requirements with the development of the Park; and

WHEREAS, both the City and the State desire to clearly articulate the intents, responsibilities, and duties of each other in relation to the proposed storm water drainage improvements.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, an Intergovernmental Agreement in a form approved by the City Attorney with the State of Colorado, Department of Personnel and Administration for the construction and maintenance of drainage improvements on property owned by the State of Colorado adjacent to Aviation Park.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council February 14, 2005 at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
