A RESOLUTION

ACCEPTANCE OF BID AND AUTHORIZING CONTRACT FOR THE 2005 OVERLAY AND PATCHING PROGRAM

WHEREAS, by Invitation of Bid No. 2519 the City of Lakewood advertised for bids for the 2005 Overlay and Patching Program and bids were opened on February 3, 2005; and

WHEREAS, the lowest responsible bidder has been determined to be Asphalt Paving Company, which has submitted its bid in the amount of two million five hundred thirty two thousand five hundred fifty three and 29/100 dollars ($2,532,553.29) pursuant to City specifications and instructions and the City desires to accept the bid of said bidder.

BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The bid of Asphalt Paving Company for the 2005 Overlay and Patching Program as described in Invitation to Bid No. 2519 is hereby accepted according to specifications as delineated in the Invitation to Bid.

SECTION 2. The City Manager is hereby authorized to execute, the City Clerk to attest, a contract with the said bidder, in form approved by the City Attorney, in the total amount of two million five hundred thirty two thousand five hundred fifty three and 29/100 dollars ($2,532,553.29). The City Manager is hereby further authorized to execute change orders to said contract, in form approved by the City Attorney, which shall not exceed, in the aggregate, an additional ten percent (10%) of the contract or two hundred fifty three thousand two hundred fifty five and 33/100 dollars ($253,255.33) for a total contract amount not to exceed two million seven hundred eighty five thousand eight hundred eight and 62/100 dollars ($2,785,808.62).

SECTION 3. The City Treasurer is hereby authorized to make payment to Asphalt Paving Company in accordance with the terms of said contract.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council February 14, 2005 at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
