ORDINANCE: O-2005-35

SUBJECT: Rezoning Case Number RZ-04-010

Rezone existing property from OF (Office) zone district to the 1-R (Large Lot Residential) zone district for the purpose of legalizing the existing residential use and to remodel the existing single-family residence.

ADDRESS: 1065 South Eaton Street

APPLICANT: Gunvor and James Tobias, owners

RECOMMENDATION: Staff recommends approval of this rezoning request to the 1-R zone district. Planning Commission, by a vote of 5 to 0 at the February 16, 2005 meeting, recommended APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: This rezoning request was heard and approved by the City Council on April 11, 2005. Inadvertently, a legal description to another case was published in the official notice and adopted with the Ordinance approving this rezone request.

In order for the rezoning request to take effect, the previous Ordinance (O-2005-17) must be repealed and City Council must adopt a new Ordinance to establish zoning for the property at 1065 South Eaton Street.

The applicant has applied to the City to rezone the property located at 1065 South Eaton Street from the OF (Office) zone district to the 1-R (Large Lot Residential) zone district. The applicant is requesting the rezoning in order to legalize the existing non-conforming use for a single-family home. Rezoning the property from OF to 1-R would permit the property to function as a legal single-family residence.

The Planning Commission recommended approval of this case by the City Council. The case is now ready for City Council action.
