REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2005-38

SUBJECT: Ordinance authorizing the of vacation of a portion of West Dartmouth Place adjacent to Bear Creek High School located at 3490 South Kipling Street, City of Lakewood, County of Jefferson, State of Colorado.

ADDRESS: 3490 South Kipling Street.

RECOMMENDATION: Adoption of the attached ordinance.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Jefferson County R-1 School District is in the process of relocating the Bear Creek Elementary School to a location North of Bear Creek High School. As part of this relocation a portion of West Dartmouth Place will be vacated and a portion of Dartmouth will be relocated further to the South in order to accommodate the construction of the elementary school. All costs in the relocation of the street will be at the expense of the School District. As a result of the relocation of West Dartmouth Place the School District will be conveying to the City that portion of their property where Dartmouth Place will be relocated, which will be a requirement before the vacation of the existing right-of-way becomes effective. City staff has reviewed this vacation request and staff's recommendation is that this request be approved. This project was discussed at the City Council Study Session of May 9, 2005.
