ORDINANCE: O-2005-34

SUBJECT: Rezoning Case Number RZ-05-006

Rezone existing property from the 5-C, COZ (Large Lot Commercial District, Colfax Overlay Zone), 2-C, COZ (Neighborhood Commercial District, Colfax Overlay Zone), OF, COZ (Office District, Colfax Overlay Zone) and 4-R (Medium Density Attached Residential District) zone districts to the PD (Planned Development) zone district in order to build a new Home Depot Store with a Garden Center.

RECOMMENDATION: Staff recommends approval of this rezoning request. Planning Commission, by a vote of 6 to 0 at the September 7, 2005 meeting, recommends APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant has submitted a request to the City to rezone the property located at 7200 West Colfax Avenue from the 5-C, COZ (Large Lot Commercial District, Colfax Overlay Zone), 2-C, COZ (Neighborhood Commercial District, Colfax Overlay Zone), OF, COZ (Office District, Colfax Overlay Zone) and 4-R (Medium Density Attached Residential District) zone districts to PD (Planned Development) zone district referred to as the Henry Official Development Plan. The applicant is requesting the rezoning in order to build a new Home Depot Store with a Garden Center.
