REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2005-32
SUBJECT: Ordinance Amendment Case Number OA-05-002
Included is the proposed Zoning Ordinance Amendment to incorporate a Performance-Based Review Process into the City of Lakewood Zoning Ordinance. Amending Articles 6 - Special Use Permits and Article 17 - Procedure for Initial Zoning and Rezoning and adding Article 7 - Performance-Based Review Process to the Zoning Ordinance.
APPLICANT: City of Lakewood
RECOMMENDATION: Staff recommends approval of this request. Planning Commission, by a vote of 7 to 0 at the August 31, 2005 meeting, recommend APPROVAL of this request by City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: At a joint City Council/Planning Commission study session on August 1, 2005, the City Council accepted the Planning Commission's recommendation to move forward to amend the Zoning Ordinance related to the Performance-Based Review Process. At the August 17, 2005 study session the Planning Commission recommended amending the Zoning Ordinance. The proposed amendment would incorporate the Performance-Based Review Process into the Zoning Ordinance and implement the Goals and Policies of the Comprehensive Plan.
The City of Lakewood Staff finds that:
1. There is a need to modify the Zoning Ordinance in order to implement the Performance-Based Review Process; and
2. The City Attorney has reviewed the amendments and found that they are in compliance with legally defensible applications of the Zoning Ordinance.
AND
That the Planning Commission recommend that the City Council APPROVE the attached Ordinance Amendment for Case Number OA-05-002:
