ORDINANCE: O-2005-29

SUBJECT: Vacation of an open space easement along the south and east sides of Lot 2, Tract A, Western Internal Medicine at Concord Plaza, a resubdivision of Concord Plaza Subdivision.

RECOMMENDATION: Approve the ordinance.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Concord Plaza Subdivision was recorded in February of 1980. The plat created a system of open space easements within the subdivision. Ordinances 81-13 and 81-30 vacated many of these easements the next year. This left the easement at the south and east sides of Tract A and other scattered remnants of open space easements within the original subdivision. In 1985, Tract A was further subdivided into Lots 1 and 2 of the Western Internal Medicine at Concord Plaza subdivision.

Lakewood Housing proposes to construct a senior housing and Head Start facility in what is now Lot 2, Tract A. The best location for the access into this property is directly across from 17th Avenue, which is where the open space easement is located. The access drive would be in conflict with the recorded open space easement.

The proposed development will be required to meet the open space requirements of the Official Development Plan on the property, thus staying consistent with the original intent of providing open space within the development.
