AN ORDINANCE

AUTHORIZING THE VACATION OF AN OPEN SPACE EASEMENT, FOR PROPERTY LOCATED AT 1700 PIERCE STREET

WHEREAS, Concord Plaza Subdivision was recorded on February 14, 1980 in Plat Book 62 at Page 7 of the Jefferson County Records; and,

WHEREAS, said subdivision created a system of open space easements throughout the subdivision; and,

WHEREAS, Ordinances O-81-13 and O-81-30 vacated the majority of the open space easements created by said plat; and,

WHEREAS, Tract A of said plat was subsequently replatted as Lots 1 and 2, Tract A of Western Internal Medicine at Concord Plaza, a resubdivision of Tract A, Concord Plaza Subdivision and recorded on June 20, 1985 in Book 84 at Page 37 of the Jefferson County Records; and

WHEREAS, the remaining portion of the open space easement is in conflict with the recommended driveway location for the development of said Lot 2.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. The easement described in Exhibit A is hereby vacated.

SECTION 2. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 22nd day of August, 2005; published by title in the Rocky Mountain News and on the City of Lakewood's website, www.lakewood.org., on the 25th day of August, 2005; set for public hearing on the 12th day of September, 2005; read, finally passed and adopted by the City Council on the day of , 2005.

EXHIBIT A

A parcel of land located in the Southwest One-quarter (SW¼) of Section 36, Township 3 South, Range 69 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, being more particularly described as follows:

All of that open space easement shown and platted along the southerly and southeasterly property lines of Tract A, CONCORD PLAZA SUBDIVISION as recorded on February 14, 1980 in Plat Book 62, at Page 7, of the Jefferson County Records; and further shown and re-platted along the southerly and southeasterly property lines of Lot 2, Tract A, of WESTERN INTERNAL MEDICINE AT CONCORD PLAZA, as recorded on June 20, 1985 in Book 84, at Page 37, of said county records.

The foregoing legal description was prepared by Michael J. Connor, Property and Purchasing Services Manager for the City of Lakewood on August 15, 2005, based upon the aforementioned plats.
