AN ORDINANCE
AUTHORIZING THE SALE OF CITY OWNED PROPERTY LOCATED AT 7200 W. COLFAX AVENUE TO COLFAX REDEVELOPMENT PARTNERS, LLC
WHEREAS, in February of 2000, the City purchased property located at 7200 W. Colfax Avenue for economic development purposes; and
WHEREAS, Colfax Redevelopment Partners, LLC intends to construct a home improvement retail store at this location; and
WHEREAS, the proposed use is consistent with the purpose for which the property was purchased; and
WHEREAS, Section 14.3 (a) of the City Charter states that "The City Council may, on such terms and conditions as the City Council deems appropriate and by ordinance, without the prior approval of the registered electors of the City, except as hereafter provided, lease, sell, or otherwise dispose of public buildings, real property, or water rights held or used for any municipal purpose"; and
WHEREAS, the City Council deems the proposed sale of the property to Colfax Redevelopment Partners, LLC for the sum of $2,662,879.10 including the cost of abatement and demolition of all buildings on said property to be appropriate.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute a real estate contract
and a deed, in form approved by the City Attorney, to convey the property located
at 7200 W Colfax to Colfax Redevelopment Partners, LLC in return for the sum
of $2,662,879.10.
SECTION 2. This ordinance shall take effect 30 days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of August, 2005; published by title in the Rocky Mountain News and on the City of Lakewood's website, www.lakewood.org., on the 11th day of August, 2005; set for public hearing on the 22nd day of August, 2005; read, finally passed and adopted by the City Council on the 22nd day of August, 2005.

TOGETHER WITH the West 20 feet of vacated Teller Street vacated by those instruments
recorded in Book 310, at Page 134 and Book 1784, at Page 16, of said records,
said Teller Street shown and platted as12th Avenue and lying adjacent to and
easterly of said Block 49, FURTHER TOGETHER WITH the East One-Half of vacated
Upham Street vacated by that instrument recorded in said Book 1784, at Page
16, said Upham Street shown and platted as 13th Street and lying adjacent to
and westerly of said Block 49, FURTHER TOGETHER WITH all of the vacated alley
lying within said Block 49, vacated by that instrument recorded in said Book
1784, at Page 16.
PARCEL 2:
All of Block 56, PLAT OF LAKEWOOD, the plat of which is recorded in Plat Book 2, at Pages 14 and 15, of said records, TOGETHER WITH the West One-Half of vacated Upham Street vacated by that instrument recorded in Book 2247, at Page 466 and 467, of said records, said Upham Street shown and platted as 13th Street and lying adjacent to and easterly of said Block 56, FURTHER TOGETHER WITH the East 0.2 foot of the North 37 feet of that property described in that instrument recorded in Book 2945, at Page 986, of said records, EXCEPT that portion of that tract of land described in that instrument recorded in Book 2805, at Page 566, lying within the above described PARCEL 2.
