AN ORDINANCE

TO VACATE THE 25 FOOT WIDE EASEMENT FOR EMERGENCY VEHICLES ACROSS TRACT A, COLLEGE WEST ESTATES LOCATED BETWEEN WEST 2ND AVENUE AND ZANG STREET, LAKEWOOD, COLORADO, FURTHER DECLARING AN EMERGENCY.

WHEREAS, the 25 foot wide easement for emergency vehicles access across Tract A, between West 2nd Place and Zang Street was shown and platted by the plat of COLLEGE WEST ESTATES, of the records of the Jefferson County Clerk and Recorder's office; and

WHEREAS, said emergency vehicle access has been relocated and a separate easement has been conveyed to the City of Lakewood therefore this platted easement is no longer necessary.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Pursuant to Title 43, Article 2, Colorado Revised Statutes, Case No. VA-05-004, and upon a finding that the described area is no longer necessary for use by the public and that no land would by a vacation be left without an established public road connecting same with another established public road, the land described in Exhibit "A" attached hereto and made a part hereof, be and the same is hereby vacated.

SECTION 2. The Lakewood City Clerk will record a certified copy of this ordinance at the Jefferson County Clerk and Recorders office.

SECTION 3. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. To clear up any title issues on the property related to this easement, which property is expected to be sold the end of July.

SECTION 4. This ordinance shall take effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 11th day of July, 2005; published by title in the Rocky Mountain News and on the City of Lakewood's website, www.lakewood.org., on the 14th day of July, 2005; set for public hearing on the 25th day of July, 2005; read, finally passed and adopted by the City Council on the 26th day of July, 2005.

Exhibit "A"

A parcel of land located in the Northwest One-quarter (NW¼) of Section 8, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

That 25 EASEMENT FOR EMERGENCY VEHICLES across Tract A, shown and platted on the plat of COLLEGE WEST ESTATES, the plat of which is recorded in Plat Book 45, at Page 24, of the records of the Jefferson County Clerk and Recorder. This vacation is intended to vacate only that easement across Tract A that is shown and platted on said COLLEGE WEST EASTATES, and is not intended to vacated any portion of the easement that was conveyed to the City of Lakewood described in that instrument recorded at Reception Number 81003910, of said records.

The foregoing legal description was prepared by Ted Van Horn on July 5, 2005, City of Lakewood, Property Management Division, 480 South Allison Parkway, Civic Center South, Lakewood, Colorado 80226-3127. This was based on the recorded plat of said COLLEGE WEST ESTATES.
