AN ORDINANCE
AUTHORIZING AN EASEMENT AND RIGHT-OF-WAY AGREEMENT FOR UNDERGROUND WATER LINE AND RELATED FACILITIES TO GREEN MOUNTAIN WATER AND SANITATION DISTRICT ACROSS ADDENBROOKE PARK, LAKEWOOD, COLORADO, FURTHER DECLARING AN EMERGENCY
WHEREAS, Green Mountain Water and Sanitation District has requested that the City of Lakewood convey to said District an Easement and Right-of-way Agreement for an underground water line and related appurtenances across land owned by the City; and
WHEREAS, said land owned by the City was conveyed to the City by the Addenbrooke family which was improved by the City as a neighborhood park; and
WHEREAS, the Charter of the City of Lakewood provides, in Section 14.3 thereof, that utility easements may be granted across such land, which the City is willing to do.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest an Easement and Right-of-way Agreement for a water line, in form approved by the City Attorney, to Green Mountain Water and Sanitation District across the land described in Exhibit "A" attached hereto and made a part hereof, for underground water line and related appurtenances.
SECTION 2. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. To keep with the project schedule so that these improvements can be constructed in the summer of 2005.
SECTION 3. This ordinance takes effect upon the Mayor's signature.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 11th day of July, 2005; published by title in the Rocky Mountain News and on the City of Lakewood's website, www.lakewood.org., on the 14th day of July, 2005; set for public hearing on the 25th day of July, 2005; read, finally passed and adopted by the City Council on the 26th day of July, 2005.

Exhibit "A"
Two parcels of land lying in the West One-half (W½) of Section 15, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
Parcel One
A parcel of land being 30.00 feet in width and being 15.00 feet on each side of the following described center line:
Beginning at a point from which the Southeast corner of said NW¼ bears S 89º32'09" E (assuming the South line of said NW¼ bears N 89º49'28" E all other bearings hereafter related thereto), a distance of 1,245.04 feet, said point of beginning being the point of commencement of the herein described centerline; thence S 64º04'44" W, a distance of 167.90 feet; thence N 26º30'57" W, a distance of 201.65 feet; thence N 27º25'01" W, a distance of 153.42 feet; thence N 28º01'46" W, a distance of 78.08 feet to a point of curve; thence northwesterly along the arc of a curve to the left, said curve having a radius of 148.14 feet, a central angle of 73º44'04" (whose long chord bears N 64º49'53" W, a long chord length of 177.75 feet), an arc distance of 190.64 feet to a point of tangency; thence S 77º42'42" W, a distance of 75.42 feet to a point of curve; thence southwesterly along the arc of a curve to the right, said curve having a radius of 421.31 feet, a central angle of 04º09'50" (whose long chord bears S 80º10'07" W, a long chord length of 30.61 feet), an arc distance of 30.61 feet to a point of non-tangency; thence N 00º00'00" E along said non-tangent line, a distance of 248.12 feet; thence N 38º21'35" E, a distance of 134.77 feet; thence N 50º11'13" E, a distance of 121.69 feet; thence N 41º31'22" E, a distance of 109.29 feet; thence N 24º22'26" E, a distance of 123.35 feet; thence N 22º42'12" E, a distance of 143.82 feet; thence N 45º26'39" E, a distance of 137.34 feet; thence N 00º00'00" E, a distance of 28.74 feet; thence N 58º01'20" E, a distance of 100.60 feet; thence N 89º41'13" E, a distance of 263.99 feet; thence N 00º15'35" E, a distance of 15.00 feet, more or less, to the South right-of-way line of South Hoyt Street as shown and platted on the plat of ALAMEDA HOMES, the plat of which is recorded in Plat Book 25, at Page 7, of the records of the Jefferson County Clerk and Recorder, said last right-of-way line being in common with the South line of said ALAMDEA HOMES, and being the point of terminus of the herein described center line. All exterior line are lengthened or shortened to their intersection point. The above described Parcel One contains an area of 69,730 square feet more or less.
Parcel Two
A parcel of land lying in the West One-half (W½) of Section 15, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado more particularly described as follows:
Commencing at a point from which the Southeast corner of said NW¼ bears S 48º54'27" E (assuming the South line of said NW¼ bears N 89º49'28" E all other bearings hereafter related thereto), a distance of 1,883.19 feet; thence N 00º00'00" E, a distance of 19.51 feet to the True Point of Beginning; thence S 89º49'29" W, a distance of 454.81 feet; thence N 00º15'43" E, a distance of 90.96 feet, more or less, to the South right-of-way line of South Iris Court as shown and platted on the plat of ALAMEDA HOMES SECOND FILING, the plat of which is recorded in Plat Book 25, at Page 48, of the records of the Jefferson County Clerk and Recorder, said last right-of-way line being in common with the South line of said ALAMDEA HOMES; thence S 89º44'17" E along said last South line, a distance of 30.00 feet; thence leaving said last South line N 00º15'43" W, a distance of 60.73 feet; thence N 89º50'10" E, a distance of 454.67 feet; thence S 44º59'57" W, a distance of 42.43 feet, more or less, to the True Point of Beginning, the above described Parcel Two contains an area of 5,269 square feet, more or less.
