AN ORDINANCE

TO REZONE LAND LOCATED AT 7205 WEST QUINCY AVENUE, CITY OF LAKEWOOD, JEFFERSON COUNTY, COLORADO

BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Upon the application of Academy Park Venture, LLP, a Colorado limited liability partnership, and Crystal Lake Cemetery Associate, Inc., a Minnesota Corporation in Lakewood Zoning Case No. RZ-04-008, and upon a recommendation of approval from the Lakewood Planning Commission, Lakewood Zoning Maps are hereby amended to include in the PD (Planned Development) zoning district and to exclude from the PD (Planned Development) and R1A (Residential One Acre) zoning districts, the property described in Exhibit A attached hereto, and made a part hereof.

SECTION 2. The Mayor and Clerk of the City are hereby authorized and directed to certify the above. The Clerk is authorized and directed to file with the Clerk and Recorder of Jefferson County the Sam's Club At Academy Park- Official Development Plan together with a certified copy of this ordinance attached thereto.

SECTION 3. This ordinance shall take effect forty-five (45) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 23rd day of May, 2005; published by title in the Denver Post and on the City of Lakewood's website, www.lakewood.org., on the 26th day of May, 2005; set for public hearing on the 13th day of June, 2005; read, finally passed and adopted by the City Council on the day of , 2005.
