AN ORDINANCE
REPEALING ORDINANCE O-83-175 AND DESIGNATING THE DENVER POST NEWSPAPER AS THE OFFICIAL NEWSPAPER FOR PURPOSES OF PUBLICATION OF ORDINANCES, PUBLIC HEARINGS, AND OTHER MATTERS
WHEREAS, the Lakewood Home Rule Charter provides that the publication of any ordinance, either in full or by title, shall be in a newspaper of general circulation in the City or in such other news media as authorized by the City Council by ordinance, and
WHEREAS, as of April 1, 2005, the Lakewood Sentinel newspaper will no longer be considered a legal newspaper in the City of Lakewood for the purposes of publishing ordinances, public hearings, and other matters; and
WHEREAS, the City Council finds the Denver Post meets the Home Rule Charter requirements for a newspaper of general circulation in the City, for the purposes of publication of ordinances.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Lakewood, Colorado, that:
SECTION 1. Ordinance O-83-175 is hereby repealed.
SECTION 2. The Denver Post, a newspaper of general circulation in the City, is hereby designated as the official newspaper for the publication of any ordinance, public hearing, or other matter requiring such public notice.
SECTION 3. All ordinances requiring publication shall be published in the
Denver Post, by reference to their assigned number and title. The notice shall
advise that the title, the description, and the full text of these ordinances
are available in electronic form on the city's official website or in printed
form in the City Clerk's office. The notice shall include instructions for obtaining
the title and the full text of such ordinances in electronic and printed form;
and the City Clerk shall publish the title and the full text of all such ordinances
on the official website of the city.
SECTION 4. In the event the publication of an ordinance by title and assigned number, or any public hearing or notice, or other matter requiring publication cannot be timely published in the Denver Post, then the City Clerk shall be authorized to publish said ordinance by title and assigned number , public hearing, public notice, or other matter in any newspaper of general circulation in the City that may, by said publication, provide for such timely publication.
SECTION 5. The City Clerk shall also comply with any other publication requirements imposed by federal or state law as may be applicable to a particular type of ordinance, resolution, or public notice.
SECTION 6. Emergency. This ordinance is necessary for the immediate preservation of the public health and safety and an emergency exists by reason of the fact that the enactment of this ordinance is necessary to the orderly and efficient administration of the business of the City of Lakewood; namely the timely and efficient adoption of City ordinances and publications; therefore, this ordinance shall take effect following adoption immediately upon the signature of this ordinance by the Mayor approving the same.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of March, 2005; published in full in the Lakewood Sentinel on the 31st day of March, 2005; set for public hearing on the 11th day of April, 2005; read, finally passed and adopted by the City Council on the 11th day of April 2005; and, signed and approved by the Mayor on the 12th day of April, 2005.
