ORDINANCE: O-2005-18
SUBJECT: An ordinance adopting a new Chapter 5.54 of the Lakewood Municipal Code relating to nongovernmental residential facilities for the treatment or supervision of out-of-state offenders.
RECOMMENDATION: Adopt the ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
This ordinance regulates nongovernmental residential facilities for the treatment or supervision of out-of-state offenders. The supervision and treatment of in-state offenders is regulated by state statute through entities such as the Jefferson County Justice Services Department.
The use of nongovernmental residential facilities for the treatment or supervision of offenders places criminal offenders in proximity with the public at large. Due to the fact that residential facilities housing out-of-state offenders are not regulated, it is necessary to ensure the public's safety by regulating the owners and operators of the facilities and regulating the out-of-state offenders who are placed within the residential facilities.
The ordinance establishes a mechanism by which the City issues a license to the facility owner if the owner meets certain requirements. The license can be revoked if the operation of the facility violates the provisions of the ordinance. The ordinance requires that the residential facility staff possess certain qualifications and that the out-of-state offenders adhere to regulations relating to prohibitions of alcohol, drugs, firearms and regulations relating to leaving the premises for employment purposes and other matters.
