SUBJECT: Rezoning Case Number RZ-04-010

Rezone existing property from OF (Office) zone district to the 1-R (Large Lot Residential) zone district for the purpose of legalizing the existing residential use and for the potential future expansion of the dwelling.

ADDRESS: 1065 South Eaton Street

APPLICANT: Gunvor and James Tobias, owners

RECOMMENDATION: Staff recommends approval of this rezoning request to the Office zone district. Planning Commission, by a vote of 5 to 0 at the February 16, 2005 meeting, recommended APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant has applied to the City for a rezoning request to rezone the property located at 1065 South Eaton Street from the OF (Office) zone district to the 1-R (Large Lot Residential) zone district. The applicant is requesting the rezoning in order to legalize the property. The existing single-family dwelling is a non-conforming use because a residence is not allowed in the Office zone district. As long as the property is zoned OF, the owners are only allowed to repair and maintain the home because of the discrepancy between the zoning and the land use. The property is approximately 15,595 square feet in size.

The Planning Commission recommended approval of this case by the City Council. The case is now ready for City Council action.
