SUBJECT: Rezoning Case Number RZ-04-003

Rezone existing property from the 3-C* (Community Commercial) with Conditions to the 4-C* (Regional Commercial) with Conditions zone district for the purpose of increasing the number of arcade machines from 10 to 33, and changing the allowed hours of operation.

RECOMMENDATION: Staff recommends approval of this rezoning request to allow 23 additional arcade machines and to formalize the hours of operation from 8:00 a.m. to 2:00 a.m. on Wednesday, Friday and Saturday evenings. The Planning Commission, by a vote of 6 to 0 at the January 19, 2005 meeting, recommended APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant has applied to the City for a rezoning request to rezone the property located at 945 South Kipling Parkway from the 3-C* (Community Commercial) with Conditions, to the 4-C* (Regional Commercial) with Conditions zone district. The applicant is requesting the rezoning in order to increase the number of arcade machines from 10 to 33, and to change the allowed hours of operation. When the property was rezoned in 1983, the conditions of approval limited the bowling alley to no more than 10 arcade machines and to operating from 8:00 a.m. to midnight daily. The information related to the conditions of the zoning was apparently lost to the Brunswick personnel, and the bowling alley has been operating outside the allowed hours of operation for a number of years.

The property is approximately 2.9 acres in size. The bowling center is 36,000 square feet.

The Planning Commission recommended approval of the rezoning request with changes to the original conditions as follows: (1) A maximum building height of twenty-two (22') feet; (2) 4-C uses are restricted to a bowling center and an amusement arcade within the bowling center only; (3) The hours of operation are from 8:00 a.m. to midnight all days of the week except Wednesday, Friday and Saturday, when the hours of operation may extend to 2:00 a.m.; (4) Maintain the berm along the west property line.
The case is now ready for City Council action.
