AN ORDINANCE

TO REZONE LAND LOCATED AT 1575 SIMMS STREET, CITY OF LAKEWOOD, COLORADO

BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Upon the application of Brian Weishaar and Brian Cruz in Lakewood Rezoning Case No. RZ-04-002 and upon a recommendation of approval from the Lakewood Planning Commission, Lakewood Zoning Maps are hereby amended to include in the OF (Office) zone district, and to exclude from the 4-R (Medium Density Attached Residential) zone district, the property described in Exhibit "A" attached hereto, and made a part thereof.

SECTION 2. The City Council of the City of Lakewood hereby approves the Public Improvements Agreement between Brian Weishaar and Brian Cruz and the City of Lakewood.

SECTION 3. The City Manager is hereby authorized to execute and the City Clerk to attest the Public Improvements Agreement with Brian Weishaar and Brian Cruz in the form approved by the City Attorney. Following execution of the Public Improvements Agreement, the City Clerk is hereby authorized to file said Public Improvements Agreement with the Clerk and Recorder of Jefferson County, Colorado.

SECTION 4. This ordinance shall take effect forty-five (45) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of February, 2005; published in full in the Lakewood Sentinel on the 3rd day of March, 2005; set for public hearing on the 28th day of March, 2005; read, finally passed and adopted by the City Council on the 28th day of March, 2005; and signed and approved by the Mayor on the 29th day of March, 2005.

LEGAL DESCRIPTION

A parcel of land being Lot 7, Block 1, THE B AND L SUBDIVISION, the plat of which is recorded in Plat Book 6, at Page 45, of the records of the Jefferson County Clerk and Recorder, further lying in the Southeast One-Quarter of Section 32, Township 3 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, containing an area of 7,618 square feet, more or less.
