AN ORDINANCE
AUTHORIZING AN AGREEMENT WITH BELMAR COMMUNICATION SERVICES, LLC REGARDING INSTALLATION, MAINTENANCE AND OWNERSHIP OF CONDUIT IN BELMAR RIGHTS-OF-WAY.
WHEREAS, the Belmar development area is generally bounded by Wadsworth Boulevard, Alameda Avenue, Pierce Street, and Center Avenue; and,
WHEREAS, rights-of-way in the Belmar development area are owned by the City of Lakewood; and,
WHEREAS, Belmar Communication Services, LLC is providing conduits for utility use in rights-of-way located in Belmar; and,
WHEREAS, the conduit will reduce long-term City maintenance and operations costs associated with rights-of-way in Belmar; and,
WHEREAS, the City and Belmar Communication Services, LLC desire to enter into an agreement relating to ownership and maintenance of a conduit system in rights-of-way in Belmar.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk attest an agreement, in form approved by the City's Special Legal Counsel, with Belmar Communication Services, LLC relating to ownership and maintenance of a conduit system in the City rights-of-way at Belmar.
SECTION 2. This ordinance shall take effect thirty (30) days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 28th day of February, 2005; published in full in the Lakewood Sentinel on the 3rd day of March, 2005; set for public hearing on the 28th day of March, 2005; read, finally passed and adopted by the City Council on the 28th day of March 2005; and, signed and approved by the Mayor on the 29th day of March, 2005.
