ORDINANCE: O-2005-2
SUBJECT: Ordinance authorizing the City of Lakewood to quit claim to the property owners of those properties at 1545 Hoyt Street and 9550 West 15th Place for any interests the City may have in a roadway and drainage easement; further declaring an emergency.
ADDRESS: 1545 Hoyt Street and 9550 West 15th Place.
RECOMMENDATION: Staff recommends approval of this ordinance authorizing conveyance of the Quit Claim Deeds.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood was contacted to see how to remove a cloud on the title of certain properties. The cloud on these properties is a roadway and drainage easement that was conveyed prior to the incorporation of the City of Lakewood to Jefferson County. The company that conveyed the easement did not own the properties at the time of the conveyance, therefore, it is difficult for the current owners to sell their properties. The owners contacted Jefferson County to see about getting this cloud on these properties removed but the County told the owners that they would have to go through the City of Lakewood since it is within the incorporated city limits. The process to clear this title problem is for the City to quit claim any interest it may have in this easement.
The emergency clause is needed on this ordinance to facilitate the timely sale of property subject to this easement.
