AN ORDINANCE

AUTHORIZING A QUIT CLAIM DEED FROM THE CITY OF LAKEWOOD TO THE PROPERTY OWNERS OF THOSE PROPERTIES AT 1545 HOYT STREET AND 9550 WEST 15TH PLACE FOR ANY INTERESTS THE CITY MAY HAVE IN A ROADWAY AND DRAINAGE EASEMENT; FURTHER DECLARING AN EMERGENCY.

WHEREAS, an easement for roadway and drainage easement was conveyed to Jefferson County prior to the incorporation of the City of Lakewood that was in error which has placed a cloud on the title to the above properties; and

WHEREAS, the process to clear these title problems is to have the City convey a Quit Claim Deed to the property owners conveying any interest the City may have in this easement; and

WHEREAS, the City of Lakewood wishes to correct this title discrepancy by executing Quit Claim Deeds to the property owners.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest a Quit Claim Deed, in form approved by the City Attorney, to the property owners for the land described in Exhibit "A" attached hereto and made a part hereof.

SECTION 2. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety and to facilitate the timely sale of property subject to this easement.

SECTION 3. This ordinance takes effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 10th day of January, 2005; published in full in the Lakewood Sentinel on the 13th day of January, 2005; set for public hearing on the 24th day of January, 2005; read, finally passed and adopted by the City Council on the day 24th of January 2005; and, signed and approved by the Mayor on the 25th day of January, 2005.

The South 5 feet of the West 117.33 feet of Lot 4, Block 4, BEVERLY HEIGHTS, the plat of which is recorded in Plat Book 5, at Page 38, of said records.
