ORDINANCE: O-2005-1
SUBJECT: Ordinance amending Exhibit "A" to Ordinance O-2004-45 declaring the City's intent to acquire interests in property for public purposes for the West 8th Place and Kipling Street Drainage Improvement Project. Further declaring an emergency.
ADDRESS: West 8th Place and Kipling Street.
RECOMMENDATION: Adoption of this ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City passed Ordinance O-2004-45 October 25, 2004, authorizing the acquisition of interests in property for public purposes for the West 8th Place and Kipling Street Drainage Improvement Project. This project has been redesigned by the Department of Public Works so the storm can be conveyed to Lakewood Gulch more efficiently. This requires that Exhibit "A" for Ordinance O-2004-45 to be amended to reflect these modifications (see attached Exhibit "A" for Ordinance O-2004-45). This project has two separate locations where these improvements will be constructed. The first location starts on the east side of Kipling Street and West 8th Place and runs easterly along the common property line between 830 and 850 Kipling Street to an existing storm sewer pipe located in the Lakewood High School parking lot.
The second location is the construction of storm sewer pipe within the existing right-of-way for Kline Drive and West 9th Drive to an existing storm sewer inlet adjacent to the properties located at 10071 and 10051 West 9th Drive. Then upgrading the existing twelve-inch storm sewer pipe to a forty-eight inch storm sewer pipe across 10071 and 10051 to a Lakewood Gulch improvement that will be constructed on a portion of the properties located at 1001 and 1005 Kipling Street.
The City will be acquiring easements from the adjacent property owners. There will be no homes or total acquisitions of any parcels as a result of this improvement project. The construction is anticipated to start by spring of 2005. The emergency clause has been requested to keep with the project schedule so that these improvements can be constructed in the spring of 2005.
