AN ORDINANCE

AMENDING EXHIBIT "A" TO ORDINANCE O-2004-45 DECLARING THE INTENT OF THE CITY OF LAKEWOOD TO ACQUIRE INTERESTS IN PROPERTY FOR PUBLIC PURPOSES FOR THE WEST 8TH PLACE & KIPLING STREET DRAINAGE IMPROVEMENT PROJECT, FURTHER DECLARING AN EMERGENCY.

WHEREAS, the limits of the project have been extended to include acquiring property interest across the properties at 10071 and 10051 West 9th Drive and 1005 Kipling Street.

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Lakewood, State of Colorado, that:

SECTION 1. Exhibit "A" of Ordinance O-2004-45 is hereby corrected and amended to read as follows: The project consists of upgrading existing storm drainage facilities and construction of new storm drainage facilities at two locations. The first location is the construction of storm sewer pipe starting at Kipling Street and West 8th Place and runs easterly along the common property line between 850 and 830 Kipling Street to the existing storm sewer pipe locate just East of 830 Kipling Street. The second location is the construction of storm sewer pipe within the existing right-of-way for Kline Drive and West 9th Drive to an existing storm sewer inlet adjacent to the properties located at 10071 and 10051 West 9th Drive. Then upgrading the existing twelve-inch storm sewer pipe to a forty-eight inch storm sewer pipe across 10071 and 10051 to a Lakewood Gulch improvement that will be constructed on a portion of the properties located at 1001 and 1005 Kipling Street.

SECTION 2. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. To keep with the project schedule so that these improvements can be constructed in the spring of 2005.

SECTION 3. This ordinance takes effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 10th day of January, 2005; published in full in the Lakewood Sentinel on the 13th day of January, 2005; set for public hearing on the 24th day of January, 2005; read, finally passed and adopted by the City Council on the 24th day of January 2005; and, signed and approved by the Mayor on the 25th day of January, 2005.
