REGULAR MEETING OF
LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY

December 9, 2004

A Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1. CALL TO ORDER

Chairman Taake called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.

ITEM 3. APPROVAL OF MINUTES

Regular Meeting August 26, 2004
Regular Meeting October 28, 2004

Mr. Wisneski moved to approve the minutes of the regular meetings held August 26, 2004, and October 28, 2004, as amended. The motion was seconded and with those present voting Aye, THE MOTION TO APPROVE THE MINUTES CARRIED.

ITEM 4. SHOW CAUSE HEARING

Tavern License
County Cork Bar & Lounge, Inc.
d/b/a County Cork Bar & Lounge

Mr. Kennebeck told the Authority a complaint was issued against this licensee for a conduct of establishment violation that occurred on August 29, 2004. The city and the licensee have reached a stipulation, but she would like to explain in mitigation a few aspects of her purchase of the corporation.
Retta Marlene Allen, 11244 W. 18th Ave., appeared before the Authority and was sworn in. Ms. Allen told the Authority she will stipulate to the violation occurring.

Mr. Wisneski moved to accept the stipulation between the Deputy City Attorney and County Cork Bar & Lounge, Inc., d/b/a County Cork Bar & Lounge. The motion was seconded, and with those present voting aye, THE MOTION TO ACCEPT THE STIPULATION CARRIED.

Ms. Allen testified she was purchasing the corporation and going through the approval process when this violation occurred. She was unaware of the violation until she was served the summons and complaint from the Liquor Inspector. Since taking over, she has installed a security system with cameras, replaced bartenders, and had closed early for the first six weeks to get rid of the riffraff. Ms. Allen said she had previously owned a bar in Montrose and never had a violation in that time. All the people involved in this incident are no longer involved with the bar or allowed into the bar.

The public hearing was closed.

The Authority members discussed the matter between themselves and agreed that since Ms. Allen was not in charge, nor in control of the establishment at the time of the violation, there would be no sanctions imposed upon the licensee.

Ms. Hansson moved that no suspension be imposed against County Cork Bar & Lounge, Inc., d/b/a County Cork Bar & Lounge located at 11810 W. Colfax Ave. The motion was seconded and with those present voting aye, THE MOTION TO IMPOSE NO SANCTION CARRIED.

ITEM 5. GENERAL BUSINESS

There was no general business to discuss.

ITEM 6. ADJOURNMENT

There being no further business to come before the Authority, Chairman Taake adjourned the meeting at 7:30 p.m.
