LAKEWOOD CITY COUNCIL
STUDY SESSION MEETING
FEBRUARY 7, 2005
MINUTES

The City Council Study Session was preceded by an LRA tour of the new Wal-mart Store at Colfax Ave. & Wadsworth Blvd.

ITEM 1 - CALL TO ORDER

Mayor Burkholder called the meeting to order at 5:300p.m. in the Cabinet Room of the Lakewood Civic Center South Building, 480 South Allison Parkway, Lakewood, Colorado.

ITEM 2 - ROLL CALL

Staff in attendance:
Mike Rock, City Manager
Roger Noonan, City Attorney

Full and timely notice of this City Council Study Session had been given and a quorum was present.

ITEM 3 - DISCUSSION - AUTO INSURANCE - NON-COMPLIANCE ORDINANCE

Deputy City Attorney Janet Young stated that a proposed ordinance to City Council would mirror the new state law regarding fines for those in violation of having no automobile insurance coverage. The ordinance would include a first-time fine for violators of $500. Although on the state level the $500 is mandatory, the municipal court asked that the judges have some discretion in the case of extenuating circumstances. Management Team agreed with allowing the judges to use their own discretion. Also, 50% of the fines collected would go to the Police Department which mirrors the state statute.

City Council reached consensus to bring the ordinance, as presented, before them to vote on at a regular City Council meeting

ITEM 4 - DISCUSSION - CHANGE TO PAWNBROKERS ORDINANCE

City Attorney Roger Noonan stated that there were some changes to the Pawnbrokers Ordinance that mirrored the new state statutes which would be brought before Council. However, discussion needed to take place regarding whether City Council wanted to impose a distance requirement between pawnshops.

Letters of support for distance requirements from the Alameda Gateway Association and the Colfax Business Association were presented to City Council. Discussion ensued.

City Council asked that distance restrictions for other types of businesses be reviewed by them as well.

City Council reached consensus to bring the ordinance, as presented, before them to vote on at a regular City Council meeting

ITEM 5 - OPEN DISCUSSION

Councilwoman Herbst stated that Roger Noonan was working on a draft ordinance for City Council to review regarding placing regulations on providers of community residential treatment facilities.

ITEM 6 - REPORTS - MAYOR AND CITY COUNCIL

Mayor and City Council members announced their attendance at various meetings and events.

ITEM 7 - ADJOURNMENT

There being no further business to come before the Council, Mayor Burkholder adjourned at the meeting at 7:30 p.m.
