RESOLUTION: 2004-77
SUBJECT: Calling for a special election for Tuesday, November 2, 2004, for the purpose of placing proposed amendments to the city charter on the ballot.
RECOMMENDATION: The City Council adopt the resolution calling the special election and authorize the City Clerk to take actions necessary to conduct such election.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Lakewood City Charter states that elections shall be held on the" first Tuesday following the first Monday" in November in odd-numbered years. TABOR provides that ballot issues concerning various fiscal matters be submitted to voters only on specified election dates, one of which is the "first Tuesday" in November of odd-numbered years. This has not been a problem since the enactment of TABOR, because the first Tuesday in November of odd-numbered years has always been preceded by a Monday. That will not be so in 2005 and again in 2011. Thus, coordinated elections conducted by the county clerk on the behalf of all cities in the county, will be held on the first Tuesday in November.
There would be obvious issues of voter confusion and apparent government inefficiency in the conduct of two elections so close together on the calendar. In addition, being able to access voter equipment from the county one week after the coordinated election would be next to impossible, since the voter equipment may not yet be "cleared" from the recent election.
The proposed amendment would change the City Charter so that elections are held on the "first Tuesday" in November in odd-numbered years.
The second proposed change to the Charter is an addition to the qualifications of the candidates running for Mayor and City Council in the City of Lakewood; stating that at the time a resident announces his/her candidacy, their current Lakewood address must be the same as shown on the voter registration rolls at Jefferson County.
The formal proposed ballot language will be brought to City Council in August 2004.
