RESOLUTION: 2004-76
SUBJECT: Resolution authorizing a license agreement to allow landscaping, a drainage culvert and other drainage improvements within the Bear Creek Drive right-of-way.

RECOMMENDATION: Approve the resolution.
FUNDING SOURCE: Not applicable.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Over the last 2 years, a natural spring has developed adjacent to 6930 Bennett Place and 6950 Bear Creek Drive. The extra water has created a marsh-like area. The property owners propose to construct a drain along Bear Creek Drive, a culvert crossing the street to provide adequate drainage and landscaping boulders.
The property owner to the north of West Bear Creek Drive, Bennett Bear Creek Farms Water and Sanitation District, has been notified of the intent for the outlet to be located on or near their property on the north side of West Bear Creek Drive. The resolution requires that the applicant provide the City with written approval from the District prior to final execution of the license agreement.
