RESOLUTION: 2004-55

SUBJECT: First Amendment to the Amended and Restated Consolidated Service Plan for the Plaza Metropolitan District Numbers 1, 2 and 3. (Belmar Project)

RECOMMENDATION: Mayor and City Council approve the Resolution for the First Amendment to the Amended and Restated Consolidated Service Plan ("First Amendment"). This approval authorizes the Plaza Metropolitan Districts (1-3) to exercise fire protection powers.

FUNDING SOURCE: Annual Service Payments are paid by the Plaza Metropolitan Districts directly to the West Metro Fire Protection District ("West Metro")

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Plaza Metropolitan Districts, acting through Plaza Metropolitan District No. 1, and West Metro entered into an intergovernmental Fire Services Agreement on March 1, 2004. The Fire Services Agreement provides West Metro with additional funding above the property tax revenue generated from the Belmar redevelopment. Belmar's ad valorem property tax was set at a predetermined base level (determined by the Jefferson County Assessor) with the adoption of the West Alameda Corridor Urban Redevelopment Plan, Phase II. Pursuant to the Fire Services Agreement, The Plaza Metropolitan District(s) will make annual service payments to West Metro beginning 2004 until 2014 to supplement Belmar's property tax payments to West Metro. In order to make such payments the Plaza Metropolitan Districts must have fire protection powers, which they currently do not have. The First Amendment confers those powers, but limits them to collecting the funds for and making the payments to West Metro. The limited fire protection powers granted in this First Amendment will not result in duplication, overlapping or fragmentation of the fire protection services currently being provided to the Belmar redevelopment.

The Fire Services Agreement is conditioned upon and subject to the City Council's approval of the First Amendment to the Amended and Restated Consolidated Service Plan.
