RESOLUTION: 2004-45

SUBJECT: Utilization of Xcel Energy's Underground Credit Fund to underground utility lines along Kipling Street from Yale to Dartmouth.

RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood's franchise agreement with Xcel Energy authorizes the use of one percent of the company's electric revenues derived from customers within the City to relocate utility facilities from overhead to underground. Burying existing electric lines is the only allowed use for this credit. The City's guidelines are defined in Resolution 91-140. Utility relocations on City capital improvement projects are the top priority.

Replacement of the Kipling Street Bridge over Bear Creek is scheduled for construction in 2004 and the utility work will occur at that time. Power lines on poles along the west side of Kipling are proposed to be buried.

Xcel Energy's cost estimate for burying the lines is $391,374. The estimate exceeds the $100,000 staff authorization limit created by Resolution 91-140 and therefore requires City Council approval.
