A RESOLUTION

FINDING A PETITION FOR ANNEXATION OF A PARCEL OF LAND BEING A PORTION OF THE NORTHWEST ONE-QUARTER OF SECTION 1, AND A PORTION OF THE NORTHEAST ONE-QUARTER OF SECTION 2, TOWNSHIP 5 SOUTH, RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN, COUNTY OF JEFFERSON, STATE OF COLORADO, TO BE IN SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31-12-107(1)

WHEREAS, a Petition for Annexation of a certain parcel of land as described in Exhibit A attached hereto, has been filed with the City Clerk of the City of Lakewood, Colorado; and

WHEREAS, the petition has been referred to the City Council of the City of Lakewood, Colorado, for a determination of substantial compliance with the requirements of Section 31-12-107(1) of the Colorado Revised Statutes; and

WHEREAS, the City Council has received testimony and evidence, and has taken official notice of all maps, records and information and other material on file with the City of Lakewood, Colorado, regarding said petition.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The Petition for Annexation of a certain parcel of land situated in a part of the Northwest Quarter of Section 1, and a part of the Northeast Quarter of Section 2 Township 5 South Range 69 West of the 6th Principal Meridian, Jefferson County, Colorado, more particularly described in Exhibit A attached hereto and incorporated herein by reference, is hereby determined to be in substantial compliance with Section 31-12-107(1) of the Colorado Revised Statutes.

SECTION 2. The City Council shall hold a public hearing on the proposed annexation on May 24, 2004, at 7:00 p.m. in the City Council Chamber, Lakewood Municipal Building, 480 South Allison Parkway, Lakewood, Colorado, to determine if the proposed annexation complies with Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes, or such parts thereof as may be required to establish eligibility for annexation.

SECTION 3. The City Clerk shall publish a Notice of Public Hearing once a week for four (4) successive weeks in a newspaper of general circulation in the area proposed to be annexed.

SECTION 4. Due to the fact that the land proposed to be annexed is more than ten (10) acres in total area, an Annexation Report is required.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on April 12, 2003, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
