RESOLUTION: 2004-35

SUBJECT: Agreement regarding managing on-street pay parking at Belmar.

RECOMMENDATION: City Council authorization of the agreement.

FUNDING SOURCE: Pay parking revenue.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

This resolution authorizes an agreement implementing pay parking at Belmar. Details of pay parking implementation were discussed during Study Sessions on February 2 and 23 and in a memorandum to City Council dated February 6.

Approximately 95% of the parking spaces at Belmar will be in parking garages and private parking lots owned and managed by The Plaza Metropolitan District No. 1 and Continuum Lakewood Development Company, LLC. Pay parking will apply to the small number of highly visible and most convenient on-street parking spaces located immediately in front of commercial properties. Unmanaged, the on-street spaces will likely be used through the day by early arriving employees and office workers making those spaces less available for patrons of Belmar businesses. On-street pay parking will encourage those who stay in Belmar for longer periods of time to park in the parking garages and parking lots rather than on-street.

Management of on-street pay parking will primarily be the responsibility of The Plaza Metropolitan District. The City will participate in the training of enforcement personnel and will process summonses for violations through the Municipal Court.

The City's costs will be the first expenses reimbursed from revenue received from pay parking. The Plaza Metropolitan District will then be reimbursed for its costs of implementing and managing pay parking. Any annual net revenue after reimbursements up to $600,000 will be used to benefit those who visit Belmar including:

1. Supporting arts and cultural programming.
2. Community event programming.
3. Providing public art.
4. Operating cultural and arts facilities.
5. Transit or transportation improvements.
6. Care and maintenance of other public facilities.

If net revenue after reimbursement of program expenses exceeds $600,000 in any year the amount above $600,000 will be shared equally between the uses listed above and other City needs.

The pay parking program will not be managed to maximize revenue. The goal of the program is to encourage availability of the most convenient parking spaces for short-term visits to businesses at Belmar.
