RESOLUTION: 2004-34
SUBJECT: Intergovernmental Agreement with The Plaza Metropolitan District No. 1 addressing certain maintenance and operations responsibilities at Belmar.
RECOMMENDATION: City Council authorization of the agreement.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Belmar development includes a number of features that are not found in other parts of Lakewood. This Intergovernmental Agreement defines certain maintenance and operational responsibilities associated with those features and identifies whether the City or the Metropolitan District serving Belmar will fulfill them. The responsibilities identified are normally the City's. Because of the upgraded features incorporated into the design of Belmar, the Metropolitan District has agreed to be responsible for certain features and activities. The District will absorb the District's costs of performing the activities listed in the agreement with two exceptions as noted below.
The agreement addresses the following:
1. Street and sidewalk maintenance and repair - The material used for crosswalk paving at several intersections and the material used for construction of certain sidewalks have been upgraded from the City's standard by the addition of color and texture. The District has agreed to maintain these locations.
2. Street signs - The District has selected non-standard components for certain public street signage and has agreed to maintain those components.
3. Street lighting - Special fixtures will be used for street lighting throughout Belmar. The District is providing, installing and maintaining the lights and paying the electrical costs for the lights. The City will annually pay to the District the amount that would have been paid by the City to Xcel Energy had standard City street lighting been provided. The initial year payment will be approximately $4700.
4. Snow and ice control - The City will plow snow and ice consistent with City policy in the portions of Belmar that are exclusively residential. The District will manage snow and ice in the mixed use and non-residential areas. Coordinated snow removal from commercial areas by the District is important since snow removal will occur from building face to building face including sidewalks on both sides of each street, parking areas, and travel lanes. During some storms, it will be necessary for the District to load snow into trucks and transport it away from the commercial area. Rather than having adjacent owners remove sidewalk snow and the City plow the streets, the District will handle both. This will make the entire operation more efficient and coordinated regardless of the size of storm.
The City will annually pay the District an amount based upon the City's estimate of its costs to handle snow during a typical winter in the mixed use and non-residential areas. The payment for the 2004-2005 winter will be $48,000, which will be more than offset by revenues the City will receive from Belmar. This arrangement will allow more City equipment to be focused on plowing the remainder of Lakewood.
5. Newspaper vending corrals - The District will provide and maintain corrals in which newspaper vending machines are allowed to be located.
It is not the intent of this agreement to eliminate City services within the District's service area. Rather, this agreement provides that the District will supplement routine City activities or, in some instances, provide all maintenance of upgraded improvements.
