A RESOLUTION

AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE PLAZA METROPOLITAN DISTRICT NO. 1 REGARDING MAINTENANCE AND OPERATIONS ACTIVITIES AT BELMAR.

WHEREAS, the Belmar development includes features and improvements unique within the City of Lakewood (City); and,

WHEREAS, the City and The Plaza Metropolitan District No. 1 (District) agree that maintenance of the unique features and some municipal operations affected by the unique features are best accomplished by the District; and,

WHEREAS, it is the intent of the City to provide standard City services or payment in lieu of such services within the Belmar development; and,

WHEREAS, the City and District desire to enter into an agreement relating to maintenance and operations at Belmar.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk attest an intergovernmental agreement, in form approved by the City Attorney, with The Plaza Metropolitan District No. 1 relating to maintenance and operations at Belmar.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on April 12, 2004, at 7 o'clock p.m. at Lakewood Civic Center South, 480 South Allison Parkway, Lakewood, Colorado.
