RESOLUTION: 2004-31

SUBJECT: To terminate the 1997 Inter-Governmental Agreement for Park and Recreation Services between the City of Lakewood and the Foothills Park and Recreation District.

RECOMMENDATION: It is recommended City Council authorize the termination of the 1997 Inter-Governmental Agreement for Parks and Recreation Services with Foothills Park and Recreation District.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: In 1997, voters approved a Joint Exclusion Plan and Agreement for Disposition of Assets and Continuation of Services Plan between Foothills Park and Recreation District and the City of Lakewood. Through the exclusion plan, the City of Lakewood became the sole provider of all public park and recreation services within the City's municipal boundaries north of Highway 285.

As part of this Joint Exclusion Plan, an agreement was made between Foothills and the City of Lakewood pertaining to the provision of park and recreation services to areas within municipal boundaries of the City located south of Highway 285. It was determined the City would provide park and recreation services to its residents and property-owners south of Highway 285 by means of a contract with Foothills Park and Recreation District. This contract took the form of an Intergovernmental Agreement (IGA) between the City and Foothills and was approved by City Council on December 9, 1997.

The Department of Community Resources recommends this Agreement be terminated effective December 31, 2004. This recommendation is based upon the fact that in accordance with the IGA, Lakewood had agreed to compensate Foothills approximately $75,000 annually for the operation and maintenance of the two Lakewood park facilities within the Foothills Service Area. The City of Lakewood has estimated the annual cost to operate and maintain the two park facilities as $12,000.

The term of this Agreement allows for either party to terminate this Agreement at the end of the fiscal year when written notice is provided thereof. The written notification must be given no later than March 31 of the year of termination.

The Agreement allows for the transfer of maintenance and operation responsibilities of two Lakewood Parks from the City to the Foothills Park and Recreation District. See attached map for Service Area boundaries. These park facilities are Lochmoor Park and Cody Street Park. Lochmoor Park is located at 7001 W. Stanford Avenue and is .3 acres in size. Cody Street Park is located at 5351 S. Cody Street and is 1.5 acres.

Compensation by the City to Foothills for maintenance services at these park facilities has been made from the City's Conservation Trust and Open Space Funds. At the time this Agreement was developed, it was determined the City had previously used Conservation Trust and Open Space funds to develop, operate, maintain, and repair Lochmoor and Cody Street Parks. It was further determined that since these maintenance functions would be performed by Foothills and not by the City, an appropriate share of the City's revenues from the Conservation Trust and Open Space go to Foothills for the services provided. The calculation for compensation to Foothills for these services is completed on an annual basis, and the assigned compensation is based upon a percentage of the City's total Conservation Trust and Open Space revenues received each year. The percentage of the revenues due Foothills is then determined by dividing the population of the Service Area by the total population of the City.
