A RESOLUTION

AUTHORIZING THE TERMINATION OF THE 1997 INTERGOVERNMENTAL AGREEMENT FOR PARK AND RECREATION SERVICES BETWEEN THE CITY OF LAKEWOOD AND FOOTHILLS PARK AND RECREATION DISTRICT.

WHEREAS, the City of Lakewood entered into an Intergovernmental Agreement between the City and the Foothills Park and Recreation District dated December 9, 1997 for the provision of park and recreation services to areas within the City located south of Highway 285 (the "agreement"); and

WHEREAS, the agreement permits either party to terminate the agreement, effective as of the end of any calendar year, by written notice given to the other party prior to March 31 of such year; and

WHEREAS, the City Council desires to terminate the agreement, effective December 31, 2004.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado as follows:

SECTION 1. The Director of the Department of Community Resources of the City is hereby authorized and directed to issue to the Foothills Park and Recreation District, on or before March 31, 2004, a notice that the City has elected to exercise its right to terminate the Intergovernmental Agreement for Park and Recreation Services between the City and the said District dated December 9, 1997, effective as of December 31, 2004.

SECTION 2. This Resolution shall be in full force and effect upon its passage and approval.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council on March 22, 2004, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
