RESOLUTION: 2004-22
SUBJECT: Agreement with Lena Gulch Metropolitan District regarding stormwater quality services.
RECOMMENDATION: It is recommended that City Council adopt a resolution authorizing an intergovernmental agreement whereby the City will provide certain stormwater quality services to the Metropolitan District and the District will pay the City for the services.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
In 1996, the City received a Stormwater Discharge Permit from the Colorado Department of Public Health and Environment. As the State of Colorado has continued to implement its responsibilities under the Clean Water Act, it has expanded the number of entities required to obtain Stormwater Discharge Permits. This year, the Lena Gulch Metropolitan District is required to obtain a permit. The Metro District includes properties in the Denver West area.
The District's obligations to the State for stormwater quality services are similar to the City's obligations. Given the limited geographic area served by the District, it will be more cost effective for the City to provide some of the stormwater quality services in the District as compared to the cost of the District implementing all phases of its new program. The District will reimburse the City for the costs of the City's stormwater quality services provided to the District.
