A RESOLUTION

AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE LENA GULCH METROPOLITAN DISTRICT REGARDING STORMWATER QUALITY SERVICES.

WHEREAS, the City of Lakewood has received from the State of Colorado a Stormwater Discharge Permit which, among other things, requires the City to provide certain stormwater quality services; and,

WHEREAS, the Lena Gulch Metropolitan District is required by the State of Colorado to obtain a Stormwater Discharge Permit which, among other things, requires the District to provide certain stormwater quality services; and,

WHEREAS, the City and District have determined that it will be more cost effective for their mutual constituents for the City to expand its stormwater quality services to serve the District; and,

WHEREAS, the District will reimburse the City for the costs of expanding City stormwater quality services to serve the District.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk attest an intergovernmental agreement with the Lena Gulch Metropolitan District for the purpose of the City providing certain stormwater quality services to the District and the District reimbursing the City for costs of said services.

INTRODUCED, READ AND ADOPTED by a vote of 8 for and 0 against at a regular meeting of the City Council on March 22, 2004, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
