RESOLUTION: 2004-16

SUBJECT: Entering into a ground water lease with the Lakewood Country Club for supplemental irrigation water.

RECOMMENDATION: Approval.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Through a Water Court action in 1979, Lakewood has the right to a majority of the deep ground water under the City of Lakewood. The amount of water under Lakewood is fairly extensive but drilling deep wells is very expensive and hitting a high flow of water source is not a sure thing.

Lakewood Country Club owns the ground water rights beneath their property and has operated wells for many years to irrigate the golf course. Lakewood Country Club recently drilled two new replacement wells. The new wells are capable of producing more than the amount of ground water available under the grounds of the Lakewood Country Club.

Lakewood Country Club representatives inquired last fall about leasing a small portion of the ground water rights owned by the City for use as a supplemental supply of irrigation water for the golf course. Policy Report 2003-4 on Lakewood's Drought Response Plan Policies and Procedures presented to City Council in April 2003 contains a provision authorizing leasing ground water to business entities that employ at least five full time employees. Lakewood Country Club has over 80 full time employees.

Lakewood Country Club would compensate Lakewood a base amount of $3,500 yearly for the lease and then pay, in addition, $350 per acre-foot yearly for ground water used annually over 10 acre-feet.
