A RESOLUTION
AUTHORIZING A REVOCABLE LICENSE AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND FIRST JEFFERSON GREEN HOMEOWNERS ASSOCIATION, ALONG THE WEST SIDE OF SOUTH ESTES STREET JUST SOUTH OF WEST GIRTON AVENUE, TO ALLOW PLACEMENT AND MAINTENANCE OF A DRY STACK RETAINING WALL
WHEREAS, First Jefferson Green Homeowners Association, has requested a Revocable
License Agreement from the City of Lakewood to allow placement of a dry stack
retaining wall on land owned by the City as a portion of South Estes Street;
and
WHEREAS, the City wishes to allow said use of the portion of said street right-of-way
as described in Exhibit "A" attached hereto and made a part hereof,
for installation, maintenance and replacement of a dry stack retaining wall
in accordance with the terms and conditions of a Revocable License Agreement
issued by the City.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Revocable License Agreement between the City of Lakewood and First Jefferson Green Homeowners Association, in form approved by the City Attorney, for the use described above of the City-owned street right-of-way described in Exhibit "A" hereto.
INTRODUCED, READ AND ADOPTED by the vote of 10 for and 0 against at a regular meeting of the City Council on January 12, 2004, at 7 o'clock p.m., at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.

Exhibit "A"
A parcel of land lying in the Southeast One-quarter of Section 34, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
That portion of the South Estes Street right-of-way that is westerly and parallel with the existing west sidewalk improvements which is bounded on the East by the back of the existing sidewalk and bounded on the West to a point 2.00 feet westerly of the back of the existing sidewalk and bounded on the North from a point that is 20.00 South of the back of the existing South sidewalk on West Girton Drive and bounded on the South to a point that is 94.00 feet southerly of said North boundary line.
