AN ORDINANCE

TO REZONE LAND LOCATED AT 1599 FENTON STREET, CITY OF LAKEWOOD, JEFFERSON COUNTY, COLORADO

BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Upon the application of Habitat for Humanity in Lakewood Zoning Case No. RZ-04-004, and upon a recommendation of approval from the Lakewood Planning Commission, Lakewood Zoning Maps are hereby amended to include in the 4-R (Medium Density Residential) zoning district and to exclude from the 5-C (Large Lot Commercial) zoning district, the property described in Exhibit A attached hereto, and made a part hereof.

SECTION 2. This ordinance shall take effect forty-five (45) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of November, 2004; published in full in the Lakewood Sentinel on the 11th day of November, 2004; set for public hearing on the 13th day of December, 2004; read, finally passed and adopted by the City Council on the 13th day of December 2004; and, signed and approved by the Mayor on the 14th day of December, 2004.

LEGAL DESCRIPTION

1599 FENTON STREET

A parcel of land lying in the Southwest ¼ of the Southeast ¼ of Section 36, Township 3 South, Range 69 West of the 6th Principal Meridian, more particularly described as follows:

Beginning at the intersection of the south line of Carson Street (West 16th Avenue) and the west line of Van Buren Avenue (Fenton Street) both as shown on the recorded plat of Edgewater;
Thence southerly along the west line of Van Buren Avenue (Fenton Street), a distance of 312.69 feet to a point on the north line of the south one acre of the east four acres of the West ½ of the Southwest ¼ of the Southeast ¼ of Section 36, Township 3 South, Range 69 West of the 6th Principal Meridian;
Thence westerly along the north line of said one acre and on said north line projected a distance of 119.58 feet to a point on the east line of the state sub-division of Edgewater as shown on the recorded plat thereof;
Thence northerly along the east line of said state sub-division of Edgewater a distance of 312.87 feet to the south line of said Carson Street (West 16th Avenue);
Thence easterly along the south line of said Carson Street (West 16th Avenue), a distance of 119.32 feet to the Point of Beginning, County of Jefferson, State of Colorado.
