AN ORDINANCE

AUTHORIZING SIGNATURE OF A QUIT CLAIM DEED FROM THE CITY OF LAKEWOOD TO GAMBRO, INC. FOR ANY INTERESTS THE CITY MAY HAVE IN LOT 6, BLOCK ONE AND LOT 4, BLOCK TWO, QUAIL STREET BUSINESS PARK FILING NO. 3; FURTHER ACCEPTING A QUIT CLAIM DEED FROM GAMBRO, INC. TO THE CITY OF LAKEWOOD FOR ANY INTEREST GAMBRO INC. MAY HAVE IN LOT 5, BLOCK 1, LOT 4, BLOCK 2, AND TRACTS A, B AND C, QUAIL STREET BUSINESS PARK FILING NO 3, FURTHER DECLARING AN EMERGENCY

WHEREAS, the City of Lakewood and Gambro, Inc. are in the process of correcting property line discrepancies in the Lakewood Industrial Park located between Quail Street and Simms Street along West Collins Avenue; and

WHEREAS, the process in which we are correcting these property line discrepancies is re-subdividing the properties which will be known as Quail Street Business Park Filing No. 3.

WHEREAS, to make sure that each entity has clear title to their appropriate lots or tracts, Quit Claims Deeds between the City of Lakewood and Gambro, Inc.'s conveying any interests each entity may have in the other entities appropriate lots or tracts needs to be executed; and

WHEREAS, the City of Lakewood and Gambro Inc, wish to correct these title discrepancies by executing Quit Claim Deeds to each other.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest a Quit Claim Deed, in form approved by the City Attorney, to Gambro Inc. for the land described in Exhibit "A" attached hereto and made a part hereof.

SECTION 2. The City of Lakewood does hereby accept the Quit Claim Deed from Gambro Inc. for the land described in Exhibit "B" attached hereto and made a part hereof.

SECTION 3. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety and the expeditious recordation of the Quail Street Business Park Filing No. 3 subdivision plat and Quit Claim Deeds.

SECTION 4. This ordinance takes effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 13th day of September, 2004; published in full in the Lakewood Sentinel on the 16th day of September, 2004; set for public hearing on the 27th day of September, 2004; read, finally passed and adopted by the City Council on the 27th day of September, 2004; and, signed and approved by the Mayor on the 28th day of September, 2004.

A parcel of land lying in the West One-quarter (W½) of Section 4, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:

Lot 6, Block One and Lot 4, Block Two, QUAIL STREET BUSINESS PARK FILING NO. 3, City of Lakewood, County of Jefferson, State of Colorado, RESERVING HOWEVER those interests conveyed to the City of Lakewood described in that Permanent Easement recorded at Reception Number F1100604, of the records or the Jefferson County Clerk and Recorder.
