ORDINANCE: O-2004-41
SUBJECT: Ordinance authorizing the City to convey an easement for water line facilities to Bancroft-Clover Water and Sanitation District for the main water line for the existing and future buildings located in the Heritage Center located in the Belmar Park located at 801 South Wadsworth Boulevard.

RECOMMENDATION: Staff recommends approval of this ordinance authorizing conveyance of the easement to Bancroft-Clover Water and Sanitation District.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood has modified and relocated a portion of the existing main water line across Belmar Heritage Center. This modification reduced the size of the existing easement, which eliminates many of the City improvement encroachments that were on the existing easement. As a result of the relocation of a portion of the water line, a new easement needs to be conveyed to Bancroft-Clover Water and Sanitation District. The District has allowed the relocation of the water line prior to the City conveying an easement for the water line with the understanding the City would convey the necessary easement after the line was installed and the location of the line was verified by a survey. The District is willing to convey their interests in the prior easement back to the City in exchange for a new easement that describes where the water line is located.
