AN ORDINANCE

VACATING A TEN FOOT WIDE UTILITY EASEMENT LYING ALONG THE SOUTHWEST PROPERTY LINE OF 2540 SOUTH GRAY COURT AND FURTHER LOCATED IN THE SOUTHEAST ONE-QUARTER OF SECTION 25, TOWNSHIP 4 SOUTH, RANGE 69 WEST OF THE SIXTH PRINCIPAL MERIDIAN, CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO

WHEREAS, the 10 foot wide utility easement was dedicated as part of THRAEMOOR CENTRAL SUBDIVISION, the plat of which is recorded in Plat Book 52 at Page 28; and,

WHEREAS, no utilities are presently located in said easement area; and,

WHEREAS, all applicable utility companies have been contacted and have indicated no objection to the vacation of the easement.

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Case No. VA-04-001, upon a finding that the described area is no longer necessary for use by the public, the easement described in the legal description attached hereto as EXHIBIT A be and the same is hereby vacated.

SECTION 2. The City Clerk is hereby instructed to record a certified copy of this Ordinance in the records of the Jefferson County Clerk and Recorder.

SECTION 3. This Ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 26th day of July, 2004; published in full in the Lakewood Sentinel on the 29th day of July, 2004; set for public hearing on the 9th day of August, 2004; read, finally passed and adopted by the City Council on the 9th day of August, 2004; and, signed and approved by the Mayor on the 10th day of August, 2004.

EXHIBIT A

The southwesterly portion of that 10' Utility Easement lying in Lot 5, THRAEMOOR CENTRAL SUBDIVISION, EXCEPT the southeasterly 10' thereof, the plat of which is recorded in Plat Book 52, Page 28, of the records of the Jefferson County Clerk and Recorder and further lying within the Southeast One-quarter of Section 25, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado.

The forgoing legal description was prepared by Dan Corrales, Right of Way Technician for the City of Lakewood based upon the aforementioned plat.
